Common use of Lease; Possession and Use Clause in Contracts

Lease; Possession and Use. Lessor hereby agrees to sell, transfer and lease to Xxxxxx, and Xxxxxx hereby agrees to acquire, purchase and lease from Lessor the property described in each Lease Schedule (defined herein) executed and delivered by Xxxxxx and Lessee, upon the terms and conditions set forth herein, together with all attachments, additions, accessions, parts, repairs, improvements, replacements and substitutions thereto (the “Equipment”). Each Lease executed and delivered by Lessor and Lessee pursuant to this Agreement shall constitute a separate and independent lease and installment purchase of the Equipment described therein. This Agreement is not a commitment by Lessor to enter into any Lease and nothing in this Agreement shall be construed to impose any obligation upon Lessor to enter into any proposed Lease. The decision whether Xxxxxx enters into any Lease is within Xxxxxx’s sole discretion. As used herein, (i) “Lease Schedule” means a schedule substantially in the form attached as Exhibit A to this Agreement, together with all addenda, riders, attachments, certificates and exhibits thereto, as the same may from time to time be amended, modified or supplemented, and (ii) “Lease” means a Lease Schedule each together with this Agreement the terms and conditions of which are incorporated therein.
