Common use of Lease or Purchase of Equipment Clause in Contracts

Lease or Purchase of Equipment. In order to provide the Services, Customer generally may obtain the necessary Equipment through one of the following two different methods: (i) most commonly, Customer will lease the Equipment from a third-party lessor with whom Alteva has contracted to perform such leasing services; or (ii) Customer may purchase the Equipment from Alteva (each of (i) and (ii) being a “Supply Method”). Regardless of which Supply Method is used, the Equipment will generally be shipped from the supplier of the Equipment (the “Supplier”) directly to the Customer. All Equipment shipments are F.O.B. Supplier’s facility. Regardless of which Supply Method is used, Alteva shall have no liability for delivery, lack of delivery, damage or loss of any Equipment. Customer shall receive whatever warranty, if any, on the Equipment that may be provided by the manufacturer of the Equipment.
