Common use of Lease Obligations Clause in Contracts

Lease Obligations. Create, incur, assume or suffer to exist any obligations as lessee for the rental or hire of real or personal property of any kind under leases or agreements to lease having an original term of one year or more that would cause the direct and contingent liabilities of Borrower and its Subsidiaries, on a consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million payable in any period of 12 consecutive months.

Lease Obligations. Create, incur, assume or suffer to exist any obligations as lessee for the rental or hire of real or personal property Property of any kind under leases or agreements to lease having an original term of one year or more that would cause the direct and contingent liabilities of the Borrower and its Subsidiaries, on a consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 15.0 million payable in any period of 12 consecutive months.

Lease Obligations. Create, incur, assume or suffer to exist any obligations as lessee (a) for the rental or hire of real or personal property in connection with any sale and leaseback transaction, or (b) for the rental or hire of any kind other real or personal property under leases or agreements to lease (excluding Capitalized Leases) having an original term of one year or more that would cause the direct and contingent liabilities of Borrower the Parent and its Subsidiaries, on a consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million 30,000,000 payable in any period of 12 consecutive months.

Create, incur, assume or suffer to exist exist, any obligations as lessee for the rental or hire of real or personal property of any kind under leases or agreements to lease (other than leases which constitute Debt) having an original term of one year or more that which would cause the aggregate direct and or contingent liabilities of Borrower the Company and its Subsidiaries, on a consolidated basis, the other Loan Parties in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million payable in any period of 12 consecutive monthscalendar months to exceed $50,000,000.

Create, incur, assume or suffer to exist exist, or permit any of its Subsidiaries to create, incur, assume or suffer to exist, any obligations as lessee for the rental or hire of other real or personal property of any kind under operating leases or agreements to lease having an original a term of one year or more that which would cause the aggregate direct and contingent liabilities of the Borrower and its Subsidiaries, on a consolidated Consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million payable in any period of 12 consecutive monthscalendar months to exceed $5,000,000.

Lease Obligations. Create, incur, assume or suffer to exist exist, or permit any of its Subsidiaries to create, incur, assume or suffer to exist, any obligations as lessee for the rental or hire of real or personal property of any kind under leases or agreements to lease having an original term of one year or more that would cause the direct and contingent liabilities of Borrower the Guarantor and its Subsidiaries, on a consolidated Consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million 38,000,000 payable in any period of 12 consecutive months.

Lease Obligations. Create, incur, assume or suffer to exist any obligations as lessee (including pursuant to a Sale and Leaseback Transaction) for the rental or hire of real or personal property of any kind under leases or agreements to rent or lease having an original term of one year or more that would cause the direct and contingent liabilities of Borrower and its Subsidiaries, on a consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million 150,000 payable in any period of 12 consecutive months.

Lease Obligations. Create, incur, assume or suffer to exist any obligations as lessee for the rental or hire of real or personal property of any kind under leases or agreements to lease having an original term of one year or more that would cause the direct and contingent liabilities of Borrower and its Subsidiaries, on a consolidated basis, in respect of all such obligations (other than Capital Lease Obligations) to exceed $3.0 million payable in any period of 12 consecutive monthsmonths to exceed an amount equal to $15.0 million, which amount shall increase by $2.0 million on each anniversary of the Original Closing Date.
