Lawful Use, Etc. If the Operating Agreement is in effect, Tenant shall comply with the terms of the Operating Agreement in connection with the use of the Retirement Community and the obligations to prohibit waste and/or unlawful nuisances set forth therein, if any. If the Operating Agreement is not in effect, Tenant shall not commit or suffer to be committed any waste on the Leased Property, or in the Facility, nor shall Tenant cause or permit any unlawful nuisance thereon or therein. Tenant shall not suffer nor permit the Leased Property, or any portion thereof, to be used in such a manner as (i) might reasonably impair Landlord's title thereto or to any portion thereof, or (ii) may reasonably allow a claim or claims for adverse usage or adverse possession by the public, as such, or of implied dedication of the Leased Property or any portion thereof.
