Knowledge of the Borrower Clause Samples

Knowledge of the Borrower. All provisions contained herein requiring the Borrower to make a determination or assessment of any event or circumstance or other matter to the best of its knowledge shall be construed to represent the actual knowledge of the President, Assistant Treasurer or Assistant Secretary of the Borrower, after such individuals have made all inquiries and investigations as may be reasonably necessary in the circumstances before making any such determination or assessment.

Knowledge of the Borrower. When used in this Agreement or any of the other Loan Documents, "knowledge" of the Borrower means actual or constructive knowledge of the Borrower's directors or officers.

Knowledge of the Borrower. All references to the knowledge of the Borrower or Holdings or to facts known by the Borrower or Holdings shall mean actual knowledge or notice of the Persons named on Exhibit F hereto.
