Common use of Issuance of the Trust Preferred Securities Clause in Contracts

Issuance of the Trust Preferred Securities. The Depositor, both on its own behalf and on behalf of the Issuer Trust pursuant to the Original Trust Agreement, executed and delivered the Underwriting Agreement. Contemporaneously with the execution and delivery of this Trust Agreement, an Administrative Trustee, on behalf of the Issuer Trust, shall manually execute in accordance with Sections 5.2, 5.3 and 8.9(a) and the Property Trustee shall deliver to the Underwriters, Trust Preferred Securities Certificates, registered in the names requested by the Underwriters, evidencing an aggregate of 2,000,000 Trust Preferred Securities having an aggregate Liquidation Amount of $50,000,000, against receipt of the aggregate purchase price of such Trust Preferred Securities of $50,000,000, by the Property Trustee.
