ISM Code, ISPS Code etc. Each of the Obligors shall comply and shall procure that a charter and/or manager comply with the ISM Code, ISPS Code, Marpol and any other international maritime safety regulation relevant to the operation and maintenance of the Rigs and provides copies of certificates evidencing such compliance to the Agent as soon as the same become available.
ISM Code, ISPS Code etc. Each Borrower shall comply and shall procure that a charter and/or manager comply with the ISM Code, ISPS Code, Marpol and any other international maritime safety regulation relevant to the operation and maintenance of the Drillships and provides copies of certificates evidencing such compliance to the Agent upon written request thereof. Each Borrower shall permit, and shall procure that any charterers and/or managers permit, one person appointed by the Agent to inspect upon the Agent giving prior written notice each of the Drillships once a year, as long as such inspection does not interfere with the operation of the Drillships (unless there is an Event of Default which is continuing, in which case, the foregoing restriction shall not apply). Such inspection shall be for the account of the Borrowers. The Drillship Owners shall instruct the classification society to send to the Agent, following a written request from the Agent, copies of all class records held by the classification society in relation to the Drillships.
ISM Code, ISPS Code etc. Each of the Obligors shall comply and shall procure that a charterer and, if applicable, manager complies with the International Convention for the Safety of Life at Sea (SOLAS) 1974 as adopted, amended or replaced from time to time including, but not limited to, the STCW 95 the ISM Code (including, but not limited to, the maintenance and renewal of valid certificates pursuant thereto), ISPS Code, Marpol and any other international maritime safety regulation relevant to the operation and maintenance of the Vessels and upon request provides copies of certificates evidencing such compliance to the Agent as soon as the same become available.
ISM Code, ISPS Code etc. Without limiting the generality of Clause 24.2 (Compliance with laws), the Ocean Rig Obligors shall comply and shall procure that any intra-group charterer including the Intra-Group Charterers and/or manager comply with the ISM Code, ISPS Code, Marpol and any other international maritime safety regulation relevant to the operation and maintenance of the Drillships and provides copies of certificates evidencing such compliance to the Agent as soon as the same become available.
ISM Code, ISPS Code etc. Without limiting the generality of Clause 23.2 (Compliance with laws) each of the Obligors shall (and for the West Elara from the Delivery Date onwards) comply and shall procure that a charterer and/or manager of the Collateral Rigs comply with the ISM Code, ISPS Code, Marpol and any other international maritime safety regulation relevant to the operation and maintenance of the Collateral Rigs and provides copies of certificates evidencing such compliance to the Agent upon written request thereof.

  • ISM Code and ISPS Code compliance All requirements of the ISM Code and the ISPS Code as they relate to the Borrowers, the Approved Manager and the Ships have been complied with.

  • ISPS Code Each Borrower shall comply with the ISPS Code and in particular, without limitation, shall: (a) procure that the Ship owned by it and the company responsible for that Ship’s compliance with the ISPS Code comply with the ISPS Code; and (b) maintain for that Ship an ISSC; and (c) notify the Agent immediately in writing of any actual or threatened withdrawal, suspension, cancellation or modification of the ISSC.

  • Labor Code Requirements The Contractor shall comply with all applicable provisions of the California Labor Code, Division 3, Part 7, Chapter 1, Articles 1 – 5, including, without limitation, the payment of the general prevailing per diem wage rates for public work projects of more than one thousand dollars ($1,000).   • Government Code Claim Requirement No suit for money or damages may be brought against the City until a written claim therefor has been presented to and rejected by the City in conformity with the provisions of San Francisco Administrative Code Chapter 10 and California Government Code Section 900, et seq. Nothing set forth in this Agreement shall operate to toll, waive or excuse Contractor’s compliance with the California Government Code Claim requirements set forth in San Francisco Administrative Code Chapter 10 and California Government Code Section 900, et seq.
