Common use of ISM and ISPS Compliance Clause in Contracts

ISM and ISPS Compliance. The Borrowers shall ensure that the relevant Company complies in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the Company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each Vessel, and the Borrowers shall promptly, upon request, supply the Agent with copies of the same.

ISM and ISPS Compliance. The Borrowers Borrower shall ensure that the relevant Company complies in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the Company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each Vessel, and the Borrowers Borrower shall promptly, upon request, supply the Agent with copies of the same.

ISM and ISPS Compliance. The Borrowers shall ensure that the relevant Company and any Environmental Affiliate complies in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the Company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC Safety Management Certificate issued in respect of each the Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each the Vessel, and the Borrowers Borrower shall promptly, upon request, supply the Agent with copies of the same.;

ISM and ISPS Compliance. The Borrowers Charterers shall ensure that the relevant each ISM Company and ISPS Company complies in all material respects with the ISM Code and the ISPS Code Code, respectively, or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the Company such company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each the Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each the Vessel, and the Borrowers Charterers shall promptly, upon request, supply the Agent Owners with copies of the same.

ISM and ISPS Compliance. The Borrowers shall ensure that the relevant each ISM Company and ISPS Company complies in all material respects with the ISM Code and the ISPS Code Code, respectively, or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the Company such company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each the relevant Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each the relevant Vessel, and the Borrowers shall promptly, upon request, supply the Agent with copies of the same.

The Borrowers Borrower shall procure that the Owner shall ensure that the relevant Company complies in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall procure that the Owner shall ensure that the Company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each Vessel, and the Borrowers Borrower shall promptly, upon request, supply the Agent with copies of the same.

ISM and ISPS Compliance. The Borrowers Borrower shall ensure that the relevant Company and the relevant manager (as applicable) complies in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the such Company and relevant manager holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each Collateral Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each Collateral Vessel, and the Borrowers Borrower shall promptly, upon request, supply the Agent with copies of the same.

The Borrowers Borrower shall ensure that the relevant each ISM Company and ISPS Company complies in all material respects with the ISM Code and the ISPS Code Code, respectively, or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure that the Company such company holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each the relevant Collateral Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each the relevant Collateral Vessel, and the Borrowers Borrower shall promptly, upon request, supply the Agent with copies of the same.. 12.1.37

The Borrowers Borrower shall ensure that the relevant Company complies comply in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure procure that the Company Operator holds (i) a valid and current Document of Compliance DOC issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each the Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each the Vessel, and the Borrowers Borrower shall promptly, upon request, supply the Facility Agent with copies of the same.

The Borrowers shall ensure that the relevant Company complies comply in all material respects with the ISM Code and the ISPS Code or any replacements thereof and in particular (without prejudice to the generality of the foregoing) shall ensure procure that the Company Manager holds (i) a valid and current Document of Compliance issued pursuant to the ISM Code, (ii) a valid and current SMC issued in respect of each the Vessel pursuant to the ISM Code, and (iii) an ISSC in respect of each the Vessel, and the Borrowers shall promptly, upon request, supply the Agent with copies of the same.
