Common use of ISIN and Common Code Numbers Clause in Contracts

ISIN and Common Code Numbers. The Issuer in issuing the Notes may use “ISIN” and/or “Common Code” numbers (if then generally in use). The Trustee shall not be responsible for the use of ISIN or Common Code numbers, and the Trustee makes no representation as to their correctness as printed on any Note or notice to Holders. The Issuer shall promptly notify the Trustee in writing of any change in the ISIN or Common Code numbers. A separate ISIN or Common Code number will be issued for any Additional Notes, unless (i) the applicable Initial Notes and such Additional Notes have the same maturity date, interest rate and optional redemption provisions and are treated as “fungible” for U.S. federal income tax purposes, (ii) both the Initial Notes and such Additional Notes are issued in the same series (as set forth in Section 2.2 without (or with less than a de minimis amount of) original issue discount for U.S. federal income tax purposes or (iii) another then-recognized identifier is used.
