ISDA Event. As to Company or Forward Purchaser, the occurrence of any Event of Default or Termination Event, other than an Event of Default or Termination Event that also constitutes a Bankruptcy Termination Event, that with notice or the passage of time would give rise to the right of the other party to designate an Early Termination Date pursuant to Section 6 of the Agreement.
