Common use of Investment by the Funds Clause in Contracts

Investment by the Funds. It shall be the responsibility of the Manager to ensure that investments of the assets of the Funds are made in such a way as to comply with the investment objectives, policies, practices and restrictions of the Funds. On Direction of the Manager or any Investment Advisor, the Trustee shall sell any or all of such investments and reinvest the proceeds thereof or exchange any or all of such investment for other investments. The Trustee, the Funds and the Manager shall not, in carrying out investment activities be in any way restricted by the provisions of the laws of any jurisdiction limiting or purporting to limit investments which may be made by trustees but shall be limited by any investment restrictions contained herein and the appropriate regulatory authorities and Applicable Laws to which the Funds are subject.
