Consistent with the Proposal, BLUE STREAM guarantees Internet service shall be available 97% of the time measured over a thirty (30) day period, 98% of the time when measured over a quarter and 99% of the time when measured over a year. The maximum level of throughput rate set forth in Section 6.A.2., at which the resident may send and receive data at any time and the maximum throughput rate generally will be sustained at least ninety percent (90%) but in no event below eighty percent (80%) of the “up to” speed at ninety- five percent (95%) of the time when measured over a 30-day period. For example, if the “up to” speed is 200Mbps, the speed will be guaranteed at least 180 180Mbps. Speed will be measured from an appropriately equipped device for BLUE STREAM’s System, that is hardwired to the ONT via the Ethernet connection and is testing speeds to the BLUE STREAM System. The through-put rate experienced by the units in the Community at any time will vary based on numerous factors, including without limitation, the condition of the resident’s devices, computer configurations, Internet and BLUE STREAM’s System congestion, time of day and the accessed website servers, among other factors.
