Common use of Interactions with Other Users Clause in Contracts

Interactions with Other Users. Retailer is solely responsible for its interactions with other Users and any other parties with whom Retailer interacts; provided, however, that Headset reserves the right, but has no obligation, to intercede in any resulting disputes between Retailer and Users. Retailer agrees that Headset will not be responsible for any liability incurred as the result of such interactions. Retailer hereby releases Headset and its successors and assigns from claims, demands, any and all losses, damages, liabilities, rights, and actions of any kind, including personal injuries, death and property damage, which is either directly or indirectly related to or arises from Retailer’s interactions with any other Users. If Retailer is a California resident, Retailer hereby waives California Civil Code Section 1542, which states, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
