Intent to Use Clause Samples

Intent to Use. Neither Seller nor any of its Affiliates has submitted to the FDA a notification of intent to use the Priority Review Voucher, as described in 21 U.S.C. 360bbb-4a(b)(3).

Intent to Use. None of Seller, BPI or any of their respective Affiliates has filed or submitted to the FDA a notification of intent to use the Priority Review Voucher.

Intent to Use. As of the Closing, Seller shall represent and warrant that: neither Seller nor any of its Affiliates has filed or submitted to the FDA, or instructed or permitted any Third Party to file or submit to the FDA, a Notice of Intent to Use the Priority Review Voucher to obtain a Priority Review.

Intent to Use. Neither Seller nor any of its Affiliates has filed or submitted to the FDA a Notice of Intent to Use the Priority Review Voucher to obtain a Priority Review.

Intent to Use. Neither Seller nor any of its Affiliates has filed or submitted to the FDA, or instructed or permitted any Third Party to file or submit to the FDA, a notice of intent to use the Priority Review Voucher pursuant to Section 524(b)(4) of the FDCA.

Intent to Use. Neither Seller nor any of its Affiliates nor, to the Knowledge of the Seller, any other Third Party has notified the FDA of intent to use the Priority Review Voucher to obtain a Priority Review.
