Insurer’s Rights Regarding Actions, Proceedings or Investigations. Until the Notes have been paid in full, all amounts owed to the Insurer have been paid in full, the Insurance and Indemnity Agreement has terminated and the Note Guaranty Insurance Policy has been returned to the Insurer for cancellation, so long as no Insurer Default exists and is continuing the following provisions shall apply:
