To be an eligible candidate, a teacher must have permanent status, must have received “meets standardperformance ratings and, in the immediately preceding four (4) years must not have received any Notices of Unsatisfactory Service and no more than one (1) Notice of Unsatisfactory Act. Other eligibility requirements may be reasonably determined by the CEO.

Any Lender whose Return Bid is not received by the Auction Agent by the Auction Response Date shall be deemed to have declined to participate in the relevant Auction with respect to all of its Term Loans.
