Common use of Initial Type of Loans Clause in Contracts

Initial Type of Loans. Subject to Section 2.13, each Revolving Borrowing shall be comprised entirely of ABR Dollar Loans or Eurodollar Loans and each Foreign Currency Loan shall be comprised entirely of Fixed Rate Loans, in each case, as a Borrower may request in accordance herewith; provided that all Borrowings made on the Effective Date must be made as ABR Revolving Borrowings. Foreign Currency Loans may only be Fixed Rate Loans. Each Swingline Loan shall be an ABR Dollar Loan. Each Lender at its option may make any Loan by causing any domestic or foreign branch or Affiliate of such Lender to make such Loan; provided that any exercise of such option shall not affect the obligation of a Borrower to repay such Loan in accordance with the terms of this Agreement.

Subject to Section 2.132.14, each Revolving Borrowing shall be comprised entirely of ABR Dollar Loans or Eurodollar Eurocurrency Loans and each Foreign denominated in a single Currency Loan shall be comprised entirely of Fixed Rate Loans, in each case, as a Borrower the Company may request in accordance herewith; provided that all Dollar Borrowings made on the Effective Date must be made as ABR Revolving Borrowings. Foreign Currency Loans Borrowings but may only be Fixed Rate Loansconverted into Eurocurrency Borrowings in accordance with Section 2.08. Each Swingline Loan and each Protective Advance shall be an ABR Dollar Loan. Each ABR Loan shall be denominated in Dollars. Each Lender at its option may make any Eurocurrency Loan by causing any domestic or foreign branch or Affiliate of such Lender to make such Loan; provided that any exercise of such option shall not affect the obligation of a Borrower the Company to repay such Loan in accordance with the terms of this Agreement.
