Industrial Practice. 14.2.1 The Contractor shall be responsible for performing its obligations under this Contract, including for associated purchases and/or subcontracting with due care and diligence and in accordance with Good Engineering & Manufacturing Practices, using sound supervisory procedures, and in a professional and workmanlike manner, in accordance with Applicable Law and the Technical Specifications and within the Time for Completion. The Contractor shall supply all Materials as per the specifications provided under the Technical Specifications. The Contractor shall ensure that the Materials shall be fit for the purpose for which each of them is intended as per the provisions of this Contract.
Industrial Practice. 9.2.1 The O&M Operator shall be responsible for purchases and/or subcontracting with due care and diligence and in accordance with Prudent Utility Practices, using sound supervisory procedures, and in a professional and workmanlike manner, in accordance with Applicable Law and the Technical Specifications. The O&M Operator shall procure all Consumables as per specification provided by OEM and from source recommended by OEM (if any) and approved by Owner. The O&M Operator shall ensure that the Consumables shall be, fit for the purpose for which each of them is intended as per the provisions of this Contract.
