Individual Filing Clause Samples

The Individual Filing clause establishes that any disputes arising under the agreement must be resolved by each party filing claims individually, rather than as part of a group or class action. In practice, this means that parties cannot join together to bring a collective lawsuit or arbitration; each claim must be pursued separately by the individual involved. This clause is designed to prevent class actions and collective proceedings, thereby limiting the scope and potential impact of legal claims and ensuring that disputes are handled on a case-by-case basis.
Individual Filing. A faculty member shall have the right to present a grievance to the District and to have such a grievance adjusted without intervention of the AFT as long as the adjustment is not inconsistent with the terms and conditions of this Agreement and provided further that the AFT has been given opportunity to be present at such adjustment and to make the views of the AFT known.
