INDEMNIFICATION FOR CONSTRUCTION WORK. SYNERGY RECOVERY NDS shall indemnify and hold harmless MEMBER, its officers and employees, from liabilities, damages, losses and costs, including, but not limited to, reasonable attorney’s attorneys’ fees, to the extent caused by the negligence, recklessness or intentional wrongful misconduct of SYNERGY RECOVERY NDS and persons employed or utilized by SYNERGY RECOVERY NDS in the performance of this Contract Agreement. These indemnifications shall survive the term of this Agreement. SYNERGY NDS agrees this indemnity obligation shall survive the expiration or earlier termination of this Agreement.
