Incremental validity Clause Samples
The Incremental Validity clause establishes that the validity of a contract or agreement is not dependent on the entire document being enforceable at once, but rather that each part or provision remains valid even if others are found invalid or unenforceable. In practice, this means that if a specific section of the contract is deemed void by a court, the remaining provisions continue to operate and bind the parties. This clause ensures that the contract as a whole is not rendered ineffective due to the invalidity of a single part, thereby preserving the parties' intentions and minimizing disruption.
Incremental validity. When there are concerns about an examinee's marginal suitability for testing, examiners should proceed with testing only when multi- disciplinary team determines that such testing would add incremental validity to risk assessment, risk management, and treatment planning decisions through the disclosure, detection, or deterrence of problem behaviors.
