Incorrect Data. (a) If there is a mistake by the Bank in preparing or providing incorrect data to the Clearing House in relation to any Instruction for the SMART Credit Service and/or PromptPay Service, the Bank shall rectify the incorrect data, and debit an additional sum from the Customer's Account or credit the Transferred Funds back to the Customer's Account, as the case may be. (b) In all cases, the Bank shall not be liable for any Losses resulting from special circumstances or damages resulting from technical difficulties in the Bank's payment system, except where such Losses are the result of wilful acts or gross negligence by the Bank. (c) The indemnities provided to the Bank under this clause shall be in addition to, and not in derogation of, any other indemnities provided by the Customer to the Bank.
Incorrect Data. Servicing HIN shall not be responsible for or have any liability for the content of any information transmitted or received through Servicing HIN’s provision of the State-Funded Participant Services or Value-Added Services, except to the extent that the content of such information is distorted or corrupted as a direct result of the negligent acts or omissions or willful misconduct of Servicing HIN. By accessing and using the SHIN-NY Platform, the State- Funded Participant Services and/or the Value-Added Services, Participant acknowledges that all data to which access is made through SHIN-NY Platform, the State-Funded Participant Services and the Value-Added Services originates from other SHIN-NY participants and not from Servicing HIN or Recipient HIN, and that all such data is subject to change arising from numerous factors, including without limitation, changes to PHI made at the request of an individual, changes in individuals’ health conditions, the passage of time and other factors. Without limiting Section 7.12, Participant hereby waives any claims or damages arising out of or related to incorrect, lost or corrupt data, reports, notifications or other outputs, including, without limitation, resulting from programming error, operator error, equipment or software malfunction, security breaches, or the use of third-party software or technology in connection with the SHIN-NY.
Incorrect Data. City shall promptly inform Contractor of any incorrect data or information. City shall bear the cost of any correction of data or information if such a correction results in additional costs to Contractor and such costs exceed those which are incurred in the process of routinely receiving and preparing correct data for normal usage. Such additional costs shall be billed on the City’s monthly invoice for Services.
Incorrect Data. In the event that the information provided by ICG to Level 3 in Exhibit A or Exhibit B to this Agreement is incorrect (“Incorrect Data”) and such Incorrect Data results in a delay of the Level 3 migration contemplated by this Agreement and the Purchase Agreement (including, without limitation, any delay with regard to an Effective Date of any Retained Number, POP or Uncovered LATA), then during the period of delay Level 3 shall have no obligation to pay (a) any Retained POP Charges or Uncovered LATA Charges with respect to any affected Retained POP or Retained Uncovered LATA (as the case may be); or (b) any Retained Number Charges as set forth on the applicable tabs of the spreadsheet attached as Exhibit B, that, in each case, are caused by the Incorrect Data.
