Common use of Inclusion by Reference Clause in Contracts

Inclusion by Reference. This Contract hereby includes, by reference, the Guaranteed Maximum Price Proposal (when approved), the General Conditions of Construction and Supplementary General Conditions, the Request for Proposal by University, Construction Manager's Proposal, the plans and specifications and other Project documents. The Construction Manager acknowledges that it has read the Design Professional’s agreement, and that while it is not incorporated herein, the Construction Manager will cooperate and coordinate its activities with the Design Professional and University to enable the successful performance of the Design Professional and University. The Construction Manager, however, does not assume any responsibility for any obligation or service of the Design Professional including indemnification arising exclusively from design errors or omissions, as provided in the University's Contract for Professional Design Services.
