Included Services. If any services, functions, or responsibilities not specifically described in this Agreement are an inherent, necessary, or customary part of the Services or are required for proper performance or provision of the Services in accordance with this Agreement, such services, functions, or responsibilities are deemed to be included within the scope of the Services to be delivered for the Charges, as if such services, functions, or responsibilities were specifically described in this Agreement.
Included Services. The Monthly Service Fee for Equipment includes all fees for the use of the Provider-owned hardware, software, operating systems, and all labor needed to install and maintain all hardware, software, operating systems delivered to client under this section. All Equipment must be used by Client for the purpose for which it was intended. Client shall not abuse the Equipment or permit it to be serviced by anyone other than Provider. Neither Client nor Client’s agent shall connect accessories supplied by anyone other than Provider to the Equipment without Provider’s written consent, which shall not be unreasonably withheld. Client shall use the Equipment only in the manner contemplated by the manufacturer and in accordance with law. Client shall not allow anyone other than Provider to disconnect or move the Equipment from the location noted on the Order. Provider must be free to make any changes needed on the Equipment. Any critical business data stored on any Equipment must be backed up by Client.
Included Services. With respect to MindAccess IoT Value Plan: (i) MindSphere Launchpad, OS Bar, and MindConnect API Services. With respect to MindAccess Developer Plan and MindAccess Operator Plan: (i) MindSphere Launchpad, OS Bar; (ii) Developer Services in Cloud Foundry with a Monthly Uptime Percentage of 95% (for MindAccess Developer); (iii) Operator Services in Cloud Foundry (for MindAccess Operator); (iv) the following Services made available via their MindSphere APIs: Asset Management, Event Management, Identity and Access Management, and MindConnect API Services. With respect to Applications from Siemens the Monthly Uptime Percentage is set out in the applicable Transaction Documents.
Included Services. Included in the Daily Rental Rate are the following services:
9.1. Telephone, Internet Access and Satellite Television or Oceanic Cable Services The telephones in the Property, if present, have local and, in some cases, long distance telephone service. Unlimited use of local service is included in the Daily Rental Rate. Long distance telephone service and pay-per-view video may be available strictly for convenience and usage charges will be billed to the credit card provided by Principal Guest(s). The Property may not have wired phone service available. The Property has in-unit connections for internet access. Guests may use this connection during occupancy. The Property has in-unit connections for television use. Television service may be cable, satellite or internet-only. Agent and Owner are not responsible for poor quality telephone service or any interruption or loss of telephone service, poor quality internet access, data loss or distortion or any interruption or loss of internet access, or poor quality satellite or cable reception, pay-per- view or other premium viewing charges or any interruption or loss of such satellite or cable reception during the period of occupancy and no refund or reduction in the Total Rent will be made for any direct and indirect damages in connection with interruption, loss or quality of the services mentioned above.
9.2. Golf Carts

Included Services i. Your membership includes primary care, including well and sick care, and basic gynecological services. Your physician will make an appropriate determination about the scope of primary care services offered by Practice on a case-by-case basis.
ii. Some services available in our office, such as rapid strep tests or urinalysis, are available at no additional cost to you.
iii. Some services, such as minor surgery, are available in our office and incur an additional fee (“Itemized Charges”).

Ownership of Provided Software Client acknowledges that its interest in any software installed by Provider on the Equipment is that of a licensee and that the software provided by Provider shall remain the property of Provider and must be returned if requested by Provider in furtherance of the Services or upon termination of this Agreement. Client further agrees to cease the use of any software or Equipment that remains the property of Provider upon cancellation or termination of this Attachment. Provider shall provide training for Client’s personnel to properly operate newly installed Equipment. Ongoing remote training will be provided at Provider’s discretion. ADDITIONAL CLIENT OBLIGATIONS Hardware Equipment Client equipment must be maintained under a manufacturer’s warranty or a current maintenance contract. Provider is not responsible for client equipment that is not maintained under a manufacturer’s warranty or maintenance contract or that is otherwise out of order. All fees, warranties, and liabilities against Provider assumes equipment is under a manufacturer’s warranty or maintenance contracts. Provider in its reasonable opinion and supported by manufacturer information, may designate certain equipment as obsolete or defective, and therefore exclude it from coverage under this Agreement. Included Services. 4.5.1.1 The Contractor shall at a minimum provide Medically Necessary services and Benefits as outlined below, and pursuant to the Georgia State Medicaid Plan, and the Georgia Medicaid Policies and Procedures Manual. Such Medically Necessary services shall be furnished in an amount, duration, and scope that is no less than the amount, duration, and scope for the same services furnished to recipients under Fee-for-Service Medicaid. The Contractor may not arbitrarily deny or reduce the amount, duration or scope of a required service solely because of the diagnosis, type of illness or Condition.
