Incidental Procedure Clause Samples

The Incidental Procedure clause defines the rules and processes for handling matters that arise incidentally during the course of a primary legal or contractual process. This clause typically covers issues such as the submission of additional documents, requests for clarification, or the management of procedural steps that are not central to the main proceedings but are necessary for their smooth operation. By establishing clear guidelines for these secondary matters, the clause ensures that incidental issues are addressed efficiently and do not disrupt or delay the main process, thereby promoting procedural clarity and minimizing disputes over minor procedural points.
Incidental Procedure. (1) An incidental procedure is one carried out at the same time as a more complex primary procedure and which requires little additional Physician resources and/or is clinically integral to the performance of the primary procedure. (2) The Allowable Charge for the primary procedure includes coverage for the incidental procedure(s). If the primary procedure is not covered, any incidental procedure(s) will not be covered.
