In this MOU. 1.3.1.1 a reference to a law is a reference to such law as it is in force for the time being taking account of any amendment, extension, application or re-enactment and includes any subordinate legislation for the time being in force made pursuant to it;
1.3.1.2 the words “include”, “includes” and “including” are to be construed as if they were immediately followed by the words “without limitation”;
1.3.1.3 the words “writing” or “written” includes faxes and e-mail;
1.3.1.4 reference to a Party “providing” Information to another (or any equivalent phrase), shall for the avoidance of doubt cover any act of making such information available, including via third parties.
In this MOU. 3.1.1. clauses that relate to the Agency as a Data Holding Agency or Requesting Agency only apply to the extent that the Agency has a role as a Data Holding Agency or Requesting Agency, as specified in Schedule 10, and
3.1.2. clauses that relate to the Agency’s access to the FVS or FIS are only applicable to the extent that the Agency has access to the FVS or FIS, as specified by Schedule 10.
