Common use of Improper execution Clause in Contracts

Improper execution. 3.1.1 If there is a defective or non-executed transaction to or from the E-Money Account, we will without undue delay refund the amount of a payment and any charges you have paid as a result subject to the other provisions of this Part C. (a) We will not be liable if the error was caused by the sender’s payment service provider (for a payment to the E-Money Account) or the recipient's payment service provider (for a payment from the E-Money Account), unless we are also that payment service provider. (b) If a payment goes to the wrong person, or is delayed, because you gave us the wrong details, we will not be liable but will use reasonable efforts to try to recover the payment. We may charge reasonable costs for doing so.
