Impose sanctions for failing to implement a CAP within the timeframe

Impose sanctions for failing to correct a finding within the timeframe stated in the CAP, except for a finding from a quality assurance review as provided for in section 3.2.3 of this section.

Impose sanctions. If the Authority does not terminate this Agreement, the Authority may impose sanctions, which may include financial sanctions or any other condition deemed appropriate. However, the Authority may not impose sanctions with which, despite Contractor’s use of Reasonable Business Efforts, Contractor cannot comply or which would likely cause a material adverse affect on the Contractor’s ability to comply with its Obligations hereunder or pursuant to the Financing Documents. Any dispute as to whether a proposed sanction violates the provisions of this Section 11.08(c) shall be resolved in accordance with Dispute Resolution, Article 13.

Impose sanctions for failing to comply with any Contract requirement except those described in sections 3.2.1 - 3.2.5, in accordance with the sanctions chart in section 3.4.1.
