Implementation of process. 1. Each Party undertakes to participate in and comply with the process for the time being established under Paragraph B2 above, and (subject to Paragraph A5 above) not to make any change to its Charging Statement or modification to its Charging Methodology except in accordance with such process. 2. The process under Paragraph B2 above shall be implemented and administered by the Joint Office. Schedule 7 – Chief Executive A. General 1. This Schedule applies to the individual from time to time appointed by the Committee to be the Chief Executive. B. The authority and responsibility of the Chief Executive 1. Except as otherwise provided in this Agreement, the Chief Executive: (a) shall manage the Joint Office and do anything that is requisite for the management and conduct of the Joint Office; (b) may delegate (in writing) any of the functions imposed on, or delegated to, him pursuant to this Agreement to a member of Staff whose position and authority is appropriate to such delegation; (c) may, on behalf of the Parties, subject to Schedule 11, enter into and terminate Secondment contracts; (d) shall not: (i) secure any resource which is not authorised by the Committee pursuant to the Resource Plan; (ii) incur any expenditure (whether or not on behalf of a Party or Parties) in the management of the Joint Office, except expenditure authorised by the Committee pursuant to the Budget; (iii) enter into a Secondment contract otherwise that in accordance with Schedule 11; or (iv) commence any litigation or arbitration on behalf of the Parties (or their Representatives). 2. The Chief Executive shall undertake his functions: (a) in a manner best calculated to promote efficiency; and (b) in compliance with the Transporter's Licence and all applicable legal requirements.

(ii) incur any expenditure (whether or not on behalf of a Party or Parties) in the management of the Joint Office, except expenditure authorised by the Committee pursuant to the Budget;

(iv) commence any litigation or arbitration on behalf of the Parties (or their Representatives).
