Immunity Act Sample Clauses

Immunity Act. The decisions made pursuant to this Agreement are governmental functions and the Parties are all governmental entities under the “Governmental Immunity Act of Utah” (Utah Code ▇▇▇. § 63G-7-101, et seq., or successor provision, the “Immunity Act”). The Parties do not waive any immunities, rights, or defenses available under the Immunity Act, nor does any Party waive any limits of liability provided by the Immunity Act. Consistent with the terms of the Immunity Act, and as provided herein, it is mutually agreed that each Party is responsible and liable for its own wrongful or negligent acts which are committed by it or by its agents, officials, or employees.
Immunity Act. Both parties are governmental entities under the Governmental Immunity Act of Utah, UTAH CODE ▇▇▇. §63G-7-101, et seq. (the “Immunity Act”). Therefore, consistent with the terms of the Immunity Act, the Parties agree that each party is responsible and liable for any wrongful or negligent acts which it commits or which are committed by its agents, officials, or employees. Neither party waives any defenses or limits of liability otherwise available under the Immunity Act or any other applicable law, and both parties maintain all privileges, immunities, and other rights granted by the Immunity Act and all other applicable law.
Immunity Act. UTOPIA retains all of its rights and immunities under the Immunity Act.
