ICS Agreement Clause Samples

An ICS Agreement clause establishes the terms and conditions under which an Interconnected Customer System (ICS) is connected to a utility or service provider's network. It typically outlines the responsibilities of both parties regarding installation, operation, maintenance, and compliance with technical standards for the interconnected system, such as a distributed energy resource or private generation facility. By clearly defining these obligations and technical requirements, the clause ensures safe and reliable integration of the ICS, minimizing operational risks and potential disputes between the customer and the service provider.

PPI is not in, nor has PPI given or received notice of, any default or claimed, purported or alleged default, or facts that, with notice or lapse of time, or both, would constitute a default (or give rise to a termination right) on the part of any person in the performance of any obligation to be performed under the ICS Agreement. A true and complete copy of the ICS Agreement, including any amendments thereto, has been delivered to EKR.
