HyperStream Underutilization Clause Samples

HyperStream Underutilization. If in any month of the Contract Years, Customer's MCI HyperStream Frame Relay Usage Charges are less than the applicable Monthly HyperStream Subminimum, then Customer will pay: (1) all accrued but unpaid usage and other charges incurred by Customer; and (2) an underutilization charge (which Customer agrees is reasonable) equal to one hundred percent (100%) of the difference between Customer's MCI HyperStream Frame Relay Usage Charges during such month of the Contract Year and the applicable Monthly HyperStream Subminimum.
