HOW DOES THE ARBITRATION PROCESS BEGIN?. If both AAA and JAMS cannot or will not serve and you and we are unable to select an Administrator by mutual consent, the Administrator will be selected by a court. If a Claim has been asserted by way of a lawsuit, the party defending against the Claim may demand arbitration of the Claim by giving a written demand for arbitration. This notice may be given after a lawsuit has been filed and may be given in papers or motions in the lawsuit.
