Hours Between Shifts. The Employer shall ensure that each employee has at least eight (8) consecutive hours free from work between each scheduled shift.
Hours Between Shifts a. Any regular work performed with less than ten (10) hours off is to be compensated at the overtime rate. However, in instances where an employee voluntarily waives the ten-hour period, the employee shall not be compensated at the overtime rate.
Hours Between Shifts. Employees shall have a minimum of ten (10) hours between shifts. Any time worked during the ten (10) hour period shall be paid at overtime rates. Parks and Recreation Department Regular Part-Time, Part-Time, and Auxiliary Aquatics Staff and Leisure Centre Front Counter/Reception staff shall be exempt from the requirements under Article 14.09 (Hours Between Shifts) with the following conditions:

Except where a provision in the Agreement, or a currently accepted practice specifically contemplates otherwise, (for example, the Overtime, Callout and non-standard work week provisions) employees shall have not less than eight (8) consecutive hours free from work between each shift worked and not less than thirty-two (32) consecutive hours free from work between each week. Where an employee is required to work within the 8 or 32 hour free period, the time worked during the work free period shall be subject to the appropriate overtime provisions.

Except in cases of emergency, (and as otherwise provided in Article 8, Section 7) employees normally shall not be required to return to work within twelve (12) hours following the end of the employee’s regularly scheduled prior shift, except during any shift change which shall not occur more than once every calendar month. Otherwise, time and one-half will be paid for all hours worked within the twelve (12) hour period. By written agreement, employees may waive the twelve (12) hour requirement.

Except by mutual agreement between the employee and the Employer or in cases of emergency, there shall be at least twelve (12) hours between assigned shifts (days, relief and nights), however, student employees may be required to work 4:00 pm to 9:00 pm and then 7:00 am to 3:30 pm on the next day.
