Common use of Holding of Shares Clause in Contracts

Holding of Shares. The Shareholder agrees with the Company that it is a requirement for the supply of water to the Shareholder that the Shareholder holds the number of shares in the Company as specified in Schedule 1 or such other number of shares as may be specified by the Company from time to time. The Company will only supply water (subject to availability) on the Shareholder holding the shares, executing this agreement, and using the water on the Property to which the water will be supplied, with the shares, this agreement and the Property all being held in the same name. The Shareholder agrees at all times to comply with this requirement.

The Shareholder Shareholder/Water User agrees with the Company that it is a requirement for the supply of water to the Shareholder Shareholder/Water User that the Shareholder Shareholder/Water User holds the that number and classes of shares Shares in the Company as specified set out in Schedule 1 or such other number of shares as may a precondition to water being available at the volume set out in Schedule 1 which water will be specified supplied by the Company from time to time. The Company will only supply water the Shareholder/Water User (subject to availabilityreliability) on and that the Shareholder holding the shares, executing this agreement, said Shares and using the water on the Property to which the water will be supplied, with the shares, this agreement and the Property all being held in the same name.
