Common use of Holder Representative Clause in Contracts

Holder Representative. The Parties agree that the Holder Representative and Buyer are each an express third party beneficiary of this Agreement and can enforce this Agreement in accordance with its terms. Grantee hereby acknowledges and consents to the appointment of LVL3 Instrumentation LLC, an Oregon limited liability company as the Holder Representative pursuant to Article 10 of the Purchase Agreement, including the Holder Representative Fund.
