Higher Class Clause Samples
The "Higher Class" clause establishes that if a party is entitled to a certain class of service, product, or benefit, they may instead receive a higher or superior class at no additional cost. In practice, this means that if a contract specifies a particular grade or level, the provider can fulfill their obligation by delivering something of greater value or quality, such as providing first-class travel instead of business class. This clause ensures flexibility for the provider while guaranteeing that the recipient will not receive anything less than what was agreed, thereby protecting the recipient's interests and simplifying the fulfillment of contractual obligations.
