Hercules Consent Sample Clauses

Hercules Consent. On or prior to the Closing Date, Lender shall have received the written consent of H▇▇▇▇▇▇▇ to B▇▇▇▇▇▇▇’s execution of the Loan Documents and the confirmation that to the best of Hercules’ knowledge, there is no event of default existing or continuing nor any other event that has occurred which would be an event of default but for the passage of time under the Hercules Loan Documents and related agreements with Borrower and/or its affiliated entities.
