Common use of Guarantees Prohibited Clause in Contracts

Guarantees Prohibited. Neither Lessee nor any Sublessee shall guarantee any indebtedness of any Affiliate or other third party, except those guarantees for the benefit of AmSouth in effect as of the Commencement Date or as may be required under the AmSouth Loan Documents as of the Commencement Date or those guarantees for the benefit of any working capital lender to whom a first priority security interest in the accounts receivable from the Facilities has been granted in accordance with the requirements of Section 39.5 of this Lease.
