Greenways Clause Samples
The 'Greenways' clause establishes provisions related to the creation, maintenance, or use of designated green spaces or corridors within a property or development. Typically, this clause outlines the responsibilities of parties for preserving landscaped areas, pathways, or natural buffers that serve recreational, environmental, or aesthetic purposes. By clearly defining obligations and permitted uses, the clause helps ensure that greenways are protected and maintained, thereby enhancing community value and supporting environmental sustainability.
Greenways. G.16.1. The general location of greenways and paved paths for pedestrians and cyclists at Carolina North shall be consistent with the 50-year development plan for Carolina North as set forth in Exhibit D. The University shall maintain continued public access to greenways and paved paths for pedestrians and cyclists in the Carolina North Tract.
G.16.2. A general plan for additional greenway locations shall be provided with the first individual site development permit application at Carolina North. This plan shall include a greenways maintenance plan that identifies maintenance routines and responsibilities and the location of site fixtures and amenities at designated trail heads (including but not limited to informational kiosk, map/locator/wayfinding device, gated access to prohibit motorized access, trash cans, water fountain/spigot, bathroom, recreational parking, and/or bicycle racks). Each Annual Report prepared after the submission of this plan shall include information about the current status of the design and funding of greenway connections at Carolina North.
G.16.3. Installation of greenways and paths for pedestrians and cyclists shall be provided for that portion of the Carolina North project subject to this Agreement as follows:
(a) A temporary, non-paved central trail to Homestead Road shall be provided when the airport runway is closed and deactivated.
(b) Additional improvements shall include:
1) A paved trail from ▇▇▇▇▇ Drive Extension through Carolina North to Homestead Road to connect with the Town’s extension of the ▇▇▇▇▇ Creek Trail from the south and the Town’s ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇ Trail to the north;
2) A paved trail through the center of the first phase campus in an east/west direction to connect with the Carrboro/Chapel Hill extension of the ▇▇▇▇▇ Creek Trail;
3) A means of crossing ▇▇▇▇▇ Drive extension; and
4) Continued trails through the Carolina North area as a separate facility with as few road intersections as possible.
(c) A map setting forth the general location of these greenway trails is attached as Map G-2.
G.16.4. One of the four improvements identified in Section G.16.3(b) shall be constructed prior to the completion of the initial 800,000 square feet of total building space within the Carolina North project constructed pursuant to this Agreement. Greenways on the Carolina North Tract shall be under the management and direction of the Carolina North Office of Forestry Management or its successor.

5.16.3. The Town plans on building a major paved greenway trail to the edges of the Carolina North Project from both the south and the north. The University and Town shall cooperate to assure that the trail systems are built in a logical manner such that non-motorized vehicle transportation and recreation are enhanced in the most efficient manner possible. The University and Town shall work to link the north-south trail corridor to other trails in the Town and University system and to eventually provide continuous access south to the Town’s ▇▇▇▇▇ Creek Trail and north to the Town Operations Center.
5.16.4. All greenways shall be built to AASHTO or Town standards for multi-use pedestrian and bicycle trails.
5.16.5. The University shall maintain all greenways built by the University under the terms of this Agreement.
5.16.6. The public shall be permitted to use all greenways on the Carolina North Tract without charge.
5.16.7. Installation of greenways and paths for pedestrians and cyclists shall be provided for that portion of the Carolina North Project subject to this Agreement as follows:

Greenways. Greenways included within platted or replatted areas shall comply with the following provisions and shall be designed and constructed in compliance with Chapter 17 of the Village Code. In the case of conflicts, the Village Engineer shall determine which requirement shall control, generally adhering to the most restrictive requirements.
(a) The subdivider shall be responsible for creating and/or maintaining an acceptable continuous drainageway through the proposed plat as determined by the Village Engineer. The subdivider shall furnish the Village Engineer with a plan outlining the greenway boundaries and location of existing drainageways, if any. In addition, the subdivider shall furnish to the Village Engineer a set of cross sections (on fifty-foot stations) of the greenway oriented upon a baseline as prescribed by the Village Engineer. Where a natural drainageway exists which has acceptable hydraulic capacities, including alignment and grade as determined by the Village Engineer, construction will not be required and the existing natural growth shall be preserved. Where such natural growth is not preserved by action of the subdivider or its agent, the subdivider shall be responsible for repairing the disturbed areas by sodding. However, in certain locations, as determined by the Village Engineer, where the hydraulic capacities, including alignment and grade, are not acceptable, then such alignment, grade and slopes shall be improved by the subdivider to handle the runoff from the one-hundred-year storm for the fully developed condition.
(b) All ditching and culvert installation shall be done in strict accordance with grades approved by the Village Engineer. The subdivider’s engineer shall be responsible for setting those required grades in the field for construction purposes.
(c) In order to assure proper drainage, the ground elevation along any lot line common with the boundary of a greenway shall not be less than four feet above the flowline of the greenway, or where designated to an elevation established by the Village Engineer, prior to the sale of affected properties. The flowline grade shall be established by the Village Engineer. All lot grading and building elevations shall provide for positive drainage. Grading or filling within the greenway limit is prohibited except as authorized by the Village Engineer.
