Granting Preference Clause Samples

The Granting Preference clause establishes a priority or advantage for a particular party or group in certain situations, such as the allocation of resources, rights, or opportunities. In practice, this clause may specify that one party receives first choice or exclusive access before others are considered, for example, giving a distributor the right to purchase products before they are offered to other buyers. Its core function is to formalize preferential treatment, ensuring that the designated party receives the intended benefit and reducing disputes over priority or access.
Granting Preference. The importing Party shall grant preferential tariff treatment to goods imported from the other Party only in cases where an importer claiming preferential tariff treatment provides to the importing customs administration upon importation of the goods, in accordance with this Chapter, a Certificate of Origin, a Declaration of Origin, or any other documentary evidence of origin that the importing Party may decide.
