The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss counts 11, 13-15, 23-25, 32, 33 and 42 of the superseding indictment, as they pertain to this defendant at the time of sentencing. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss counts Three, Four, and Six through Nine at sentencing. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. The defendant recognizes that the United States= States’ agreement to forego prosecution of all of the criminal offenses with which the defendant might be charged is based solely on the promises made by the defendant in this agreement and the limitations set out hereinagreement. If the defendant breaches this plea agreement, the United States retains the right to proceed with the original charges and any other criminal violations established by the evidence. The defendant expressly waives any her right to challenge the initiation of the dismissed or additional charges against defendant her if defendant she breaches this agreement. The defendant expressly waives any her right to assert a statute of limitations defense if the dismissed or additional charges are initiated against defendant her following a breach of this agreement. The defendant further understands and agrees that if the Government elects to file additional charges against defendant her following her breach of this plea agreement, defendant she will not be allowed to withdraw this her guilty plea. Further, the defendant agrees to: (1) voluntarily terminate and cease any participation or future participation as an agent, business representative or petitioning employer on behalf of any foreign national with respect to any matter concerning the U.S. Department of Labor’s Foreign Labor Certification programs, including any and all Department of Labor certifications, assistance, and resources; (2) voluntarily terminate and cease any participation or any future participation as an agent, representative or petitioning employer of any foreign national with respect to any program administered by the U.S. Department of Homeland Security, including the Citizenship and Immigration Services, including the filing for, application for, or petition for immigration benefits on behalf of any foreign national as a sponsoring petitioning employer; (3) execute any and all documents required by the U.S. Department of Homeland Security or the U.S. Department of Labor to accomplish the agreements reached by the parties herein at any time of the government’s choosing.

Government’s Agreements. Based upon evidence in its possession at this time, the United States Attorney=s Office for the Western District of MissouriStates, as part of this plea agreement, agrees not to bring any additional charges against the defendant for any federal criminal offenses related to the charges defendant has pled to herein crimes charged in the Indictment for which it has venue and which arose out of the defendant=s ’s conduct described above. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss as to HUTCHINSON only, Counts 2 through 4, 8, 13 through 17, 19, and 20 of the First Superseding Indictment, and the original Indictment in its entirety, at sentencing. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person Person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss Count 16 at sentencing. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. The defendant recognizes that the United States= States’ agreement to forego prosecution of all of the criminal offenses with which the defendant might be charged is based solely on the promises made by the defendant in this agreement and the limitations set out hereinagreement. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District U.S. Department of Missouri Justice, Antitrust Division has no knowledge. The defendant recognizes that the United States= agreement to forego prosecution of all of the criminal offenses with which the defendant might be charged is based solely on the promises made by the defendant in this agreement and the limitations set out hereinagreement. If the defendant breaches this plea agreement, the United States retains the right to proceed with the original charges and any other criminal violations established by the evidence. Based upon evidence in its possession at this time, the United States Attorney=s ’s Office for the Western District of Missouri, as part of this plea agreement, agrees not to bring any additional charges against defendant for any federal criminal offenses related to the charges defendant has pled conduct described in the indictment or disclosed to herein law enforcement during the underlying investigation, including but not limited to conspiracy to solicit a crime of violence in violation of 18 U.S.C. § 371 and interstate threatening communications in violation of 18 U.S.C. § 875(c), for which it has venue and which arose out of the defendant=s ’s conduct described above. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss Count One, which charges her with conspiracy to solicit another to commit a crime of violence in violation of 18 U.S.C. § 371, at sentencing. Further, the Government agrees to move to dismiss at the time of sentencing Counts One, Two, Five, Six, Twenty-One, Twenty-Two, Thirty-Seven, Thirty-Eight, and Counts One and Two of Indictment No. 12-00307-01-CR-W-BCW. Based upon evidence in its possession at this time, the United States Attorney=s ’s Office for the Western District of Missouri, as part of this plea agreement, agrees not to bring any additional charges against the defendant for any federal criminal offenses related to maintaining the charges defendant has pled to herein motel room for the use of heroin on April 2, 2014, for which it has venue and which arose out of the defendant=s ’s conduct described above. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss the original indictment and Count 1 of the superseding indictment at sentencing. The United States also agrees to recommend that the defendant be sentenced to 60 months’ imprisonment. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. Government’s Agreements. Based upon evidence in its possession at this time, the United States Attorney=s ’s Office for the Western District of Missouri, as part of this plea agreement, agrees not to bring any additional charges against defendant for any federal criminal offenses related to the charges defendant has pled to herein her theft of government money for which it has venue and which arose out of the defendant=s ’s conduct described above. Additionally, and consistent with the Rule 11(c)(1)(C) provisions of this agreement that require the Court to impose sentence within the advisory guideline range agreed to by the parties, the United States Attorney for the Western District of Missouri agrees to recommend at the time of sentencing that the Court impose a sentence at the low-end of the agreed guideline range, i.e., a sentence of probation. The defendant understands that the Court is not required to follow this recommendation and, even if the Court accepts this plea agreement, the Court could reject the Government’s recommendation and permissibly impose a sentence requiring the defendant to serve up to 6 months of incarceration. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss Count One at sentencing. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. Further, the Government agrees to move to dismiss at the time of sentencing counts 7-12, 18, 19, 23-29, 34, 39-43. If the defendant complies with the cooperation terms of this plea agreement set forth below, the Government will file a motion pursuant to U.S.S.G. § 5K1.1, requesting that the court sentence the defendant below the applicable sentencing guideline range. The defendant expressly waives any his right to assert a statute of limitations defense if the dismissed or additional charges are initiated against defendant him following a breach of this agreement. The defendant further understands and agrees that if the Government elects to file additional charges against defendant him following his breach of this plea agreement, defendant he will not be allowed to withdraw this his guilty plea.

Government’s Agreements. Based upon evidence in its possession at this time, the United States Attorney=s ’s Office for the Western District of Missouri, as part of this plea agreement, agrees not to bring any additional charges against defendant for any federal criminal offenses related to the charges defendant has pled to herein for which it has venue and which arose arise out of the defendant=s misprision conduct described abovecharged in the Superseding Information, or were committed while the defendant was a law enforcement officer. The Government further agrees that it will dismiss the pending indictment at the time of sentencing in this case. The defendant understands that this plea agreement does not foreclose any prosecution for an act of murder or attempted murder, an act or attempted act of physical or sexual violence against the person of another, or a conspiracy to commit any such acts of violence nor does it foreclose prosecution of or any criminal activity of which the United States Attorney for the Western District of Missouri has no knowledge. The defendant recognizes that the United States= States’ agreement to forego prosecution of all of the criminal offenses with which the defendant might be charged is based solely on the promises made by the defendant in this agreement and the limitations set out hereinagreement. Additionally, the United States Attorney for the Western District of Missouri agrees to dismiss as to XXXXXXXXXX only, Counts 2 through 4, 8, 13 through 17, 19, and 20 of the First Superseding Indictment, and the original Indictment in its entirety, at sentencing.
