Governmental Function. In accordance with C.G.S. § 1-218, if the amount of this Contract exceeds two million five hundred thousand dollars ($2,500,000), and the Contractor is a "person" performing a "governmental function", as those terms are defined in C.G.S. § 1 200(4) and (11), the Agency is entitled to receive a copy of the Records and files related to the Contractor's performance of the governmental function, which may be disclosed by the Agency pursuant to the FOIA.
Governmental Function. 1. (a) Remuneration, other than a pension, paid by a Contracting State or a local authority thereof to an individual in respect of services rendered to that State or authority shall be taxable only in that State.
Governmental Function. The Parties expressly agree that, in all things relating to this Agreement, the COUNTY is performing a governmental function, as defined by the Texas Tort Claims Act. The Parties further expressly agree that every act or omission of the COUNTY, which, in any way, pertains to or arises out of this Agreement falls within the definition of governmental function.
Governmental Function. In accordance with C.G.S. § 1-218, if the amount of this Contract exceeds two million five hundred thousand dollars ($2,500,000), and the Contractor is a “person” performing a “governmental function”, as those terms are defined in C.G.S. § 1-200, the University is entitled to receive a copy of the records and files related to the Contractor’s performance of the governmental function, which may be disclosed by University pursuant to the FOIA.
Governmental Function. The parties expressly agree that, in all things relating to this Agreement, the parties are performing a governmental function as defined by the Texas Tort Claims Act. The Parties further expressly agree that every act or omission of the OSAR or County of El Paso or JPD, which in any way pertains to or arises out of this Agreement falls within the definition of a governmental function.
Governmental Function. The Parties agree that the County and Subrecipient are entering this Agreement in the exercise of their respective governmental functions under the Texas Tort Claims Act. The Parties also agree that the County and Subrecipient are entering into this Agreement each as a governmental entity performing a governmental function in their own respective capacity.
Governmental Function. In accordance with Ind. Code § 10-14-3-15, any function under this Agreement and any other activity relating to emergency management is a governmental function.
Governmental Function. The City and the County expressly agree that, in all things relating to this Interlocal Agreement, the parties enter into this Interlocal Agreement for the purpose of performing governmental functions and are performing governmental functions, as defined by the Texas Tort Claims Act. The parties further expressly agree that every act or omission of each party, which in any way pertains to or arises out of this Agreement, falls within the definition of governmental function.
Governmental Function. The parties expressly agree that, in all things relating to this Agreement, the CITY enters into this Agreement for the purpose of performing a governmental function and is performing a governmental function, as defined by the Texas Tort Claims Act. Neither party waives any immunity under the Texas Tort Claims Act. The parties further expressly agree that every act or omission of the CITY, which in any way pertains to or arises out of this Agreement, falls within the definition of governmental function. The parties also agree that EPCC is entering into this Agreement as part of its duty to provide educational and community services.
Governmental Function. Concessionaire expressly agrees that, in all things relating to this Agreement, Xxxxxx is performing governmental functions, as defined by the Texas Tort Claims Act. Concessionaire further expressly agrees that every act or omission of Lessor that, in any way, pertains to or arises out of this Agreement falls within the definition of governmental function. Accordingly, Concessionaire further agrees that liability, if any, for damages for injury to or death of any person or for damage to any property, arising, if at all, out of or in connection with activities under this Agreement, shall be determined under the limited waiver of sovereign immunity contained in the Texas Tort Claims Act.
