Common use of Goal Posts Clause in Contracts

Goal Posts.  Where the Hirer provides and erects goal posts, whether temporary or otherwise, they must comply with the relevant Australian Standard No. HB 227 – 2003 and to be safe to use in accordance with the code of practice outlined by the sports own governing body.  When erecting goal posts, the Hirer should take into account the matters set out in the Department of Local Government Circular 05/14.  Council, in accepting a booking from a sporting code upon request may, subject to available resources, erect goal posts prior to the date required after the hiring club has pre-paid an amount estimated by the Manager, Environment and Open Space as being adequate to cover labour and materials required to satisfactorily erect those posts. Otherwise, the club hiring the Council facility will be responsible for the erection of goal posts.  A designated person/club official must inspect all facilities, including the playing field and the general environment prior to starting any training/game to ensure that it is fit and safe for the use to which it is booked.  A copy of a Pre Use Inspection Checklist form for all users is attached to the ‘Application to Use a Sports field and Facility’ form.  The Hirer shall complete and forward to Council a facility maintenance inspection sheet when reasonable maintenance requests are required (normally on a monthly basis).  The Hirer is responsible for the provision of routine maintenance during the period of the Agreement for works or damages caused as a result of the hiring activity.  The operation of night lighting is at the Hirer’s risk and it is the Hirer’s responsibility to ensure that field lighting is suitable for the Hiring activity. Council will provide a lighting lux level for field or ground upon request.  The cost of operation of these lights shall be the Hirer’s responsibility.  Sports ground lights are to be turned off by 10.00 pm, unless otherwise specifically approved by Council.  The Hirer is responsible for ensuring that night lights are turned off at the end of use and switch boxes are locked. Should lights be switched off or expire during token use a cooling down period is required of at least ten minutes before switching back on.  Maintenance of these lights shall be coordinated and at the discretion of Council depending on fund allocations and resource availability.  Hirers and users are not to access irrigation or alter timers controlling irrigation systems. An exception may be made for volunteer cricket wicket curators who must advise Council of when and how frequently they will access irrigation equipment.  Any matters relating to irrigation are to be reported to Council. Hirers are to ensure that no vehicles are driven on sportsgrounds unless they are specialist vehicles involved in erecting goal posts or related to an event otherwise approved by Council. In these instances, care should be taken not to damage the grounds as Council will hold the Hirer responsible for any damage so caused. Prior written approval is required for any vehicles to be on a sportsground.  Use of club rooms, canteens and change rooms forms part of this Agreement. The Hirer will at its own discretion and shall act reasonably at all times to provide access to these facilities where co-allocation has been granted by Council.  Where the Hirer has granted access to third parties to use canteens, club rooms or change rooms the Hirer shall ensure that physical access is available to these facilities for the during of those events.  Council entry to club rooms, canteens and change rooms is to be unrestricted and Hirers must clean up those areas used following each activity/event booked.  Storage of foodstuffs and equipment beyond the end of the hiring period is not permitted. At the end of the hiring period all foodstuffs and equipment must be removed from amenities and canteens within 14 days from the end of the hiring period unless prior arrangements have been made with Council.  Council will not accept responsibility for any equipment or foodstuffs left on Council premises.  Cigarettes are not to be stored on or sold from Council premises.  If the Hirer has the necessary consents and licences, alcohol may be sold from Council premises but all alcohol is to be removed at the end of the day’s activities and no alcohol is to remain on Council premises overnight.  The Hirer will not store at the facility any quantities of consumer goods which are likely to attract forced entry to the building. Should it become evident to Council that the storage of consumables of any kind by the Hirer has contributed to any damage to the Facility due to attempts of forced entry, then the Hirer shall bear all costs incurred by Council for the repair of any such damage and meet any excess insurance claims relating to such damage.  The Hirer must ensure that all electrical appliances brought onto Council premises have current electrical tagging by a registered electrician and that that tagging remains up-to-date.  The Hirer shall be responsible to ensure that any Fire Evacuation plans of the building are clearly displayed and accessible to any person using the facility.  Commercial food vendors are not permitted to operate on Council sports fields/grounds for sporting events unless prior written approval of Council is first obtained.   Council will clean and maintain any public toilets at the sportsground that are ordinarily open for use by the general public outside the hiring period.  The Hirer shall be responsible for keeping the toilets in change rooms, club rooms and those used by the public during their events in a clean and tidy condition. Toilet facilities are to be cleaned at least weekly and/or during and following any activity undertaken by the Hirer at the facility.  The Hirer shall provide toilet paper for its own use of the toilet facilities.  Council shall provide toilet paper where the toilet facilities are used by third parties including other sporting clubs, community groups or schools.  The Hirer shall grant access to the toilet facilities to other sporting clubs, community groups or schools when co-allocation of the facility is granted by Council.  Where Council grants access to other sporting clubs, community groups or schools for the use of the toilet facilities and it is inconvenient for the toilet facilities to be opened by the seasonal Hirer; Council will provide access to the toilet facilities upon request detailed in the ‘Sports Ground Usage – Casual’ application form.  Council shall only provide such access to the toilet facilities to other sporting clubs, community groups or schools after first consulting the Hirer.  Other sporting clubs, community groups or schools must leave the toilet facilities clean and tidy.  Council and the Hirer shall inspect the toilet facilities promptly following such use by other sporting clubs, community groups or schools. When toilet facilities are not left clean and tidy, photographic evidence (date and time stamped) should to be reported to Council within seven (7) days after the inspection.  Should Council be satisfied that the other user(s) have failed to keep the toilet facilities clean, it:
