German Type Certification Basis. (a) The LBA will develop its type certification basis using the applicable airworthiness standards in effect on the date application was made to the FAA for the U.S. type certificate. The applicable airworthiness requirements may be supplemented with the following additional requirements: (1) Special conditions: For the development of special conditions, the LBA will review: (i) All novel or unusual design features (ii) The intended use of the product, (iii) Its service history, and (iv) the experience from other similar products in service or products having similar design features, having shown that unsafe conditions may develop. (2) Applicant’s must also comply with the applicable noise and exhaust emissions standards in effect on the date of application to the LBA for German type certificate. the noise standards of 14 CFR Part 36 in effect on the date of U.S. type certification.
