Common use of General Uses Clause in Contracts

General Uses. The Business Associate/QSO shall not use or disclose PHI other than as permitted or required by this Agreement or as required by law. The Business Associate/QSO may use PHI for the functions, activities, or services performed for or on behalf of the Covered Entity as specified in the Underlying Agreement provided that such use or disclosure would not violate this Agreement, the HIPAA regulations, or the HITECH Act. In the event that this Agreement conflicts with any other written agreement made between the Parties relating to the exchange of PHI, this Agreement shall control.
