Common use of General Overdraft Liability Clause in Contracts

General Overdraft Liability. If on any day, the available funds in your checking account are not sufficient to cover checks and other items (ACH, access device (debit or ATM) transactions) posted to your account, those checks and other items will be handled in accordance with our overdraft procedures and the terms of this Agreement. If we pay a check or other item that overdraws your account, you are liable for and agree to pay the overdraft amount and any nonsufficient funds fee pursuant to the rate and fee schedule. If we do not pay the check or item, we will return it unpaid and you agree to pay any applicable fee pursuant to the rate and fee schedule. We reserve the right to pursue collection of previously dishonored items at any time.
