Future Releases. Unless otherwise specifically provided in the Statement of Work, if improved versions (e.g., patches, bug fixes, updates or releases) or upgrades of any SaaS versions or Software Product are developed by the Contractor, and are made available to other customers, they will be made available to the State at no additional cost only if such are made available to other customers at no additional cost.
Future Releases. After release of such press release, if either Party desires to make a public announcement concerning the material terms of this Agreement, such Party shall give reasonable prior advance notice of the proposed text of such announcement to the other Party for its prior review and approval (except as otherwise provided herein), such approval not to be unreasonably withheld or delayed. A Party commenting on such a proposed press release shall provide its comments, if any, within two (2) Business Days after receiving the press release for review. To the extent required by applicable Laws, including regulations promulgated by applicable securities exchange, each Party shall have the right to make a press release announcing the achievement of each milestone under this Agreement as it is achieved, and the achievements of Marketing Approvals in the Territory as they occur, subject only to the review procedure set forth in the preceding sentence. In relation to a Party’s review of such an announcement, such Party may make specific, reasonable comments on such proposed press release within the prescribed time for commentary, but shall not withhold its consent to disclosure of the information that the relevant milestone has been achieved and triggered a payment hereunder. Future Releases. 6.3.1 In consideration for the service charge for Support Service the Customer shall be entitled to receive future releases of a Software Product. In general a future release of a Software Product will contain minor enhancements and error corrections to an earlier version of that Software Product and can be installed by the Customer with minimal disruption.

If the Contractor offers new versions or upgrades to the Software Product, they shall be made available to the State at the State’s option at a price no greater than the Contract price plus a price increase proportionate to the increase from the list price of the original version to that of the new version, if any. If the Software Product has no list price, such price increase will be proportionate to the increase in average price from the original to the new version, if any, as estimated by the Contractor in good faith.

Unless otherwise specifically provided in this Contract or the Statement of Work, if improved, upgraded, or enhanced versions of any software product under this Contract are developed by the Contractor and are made available to other licensees, they will be made available to the County at the County’s option, provided such versions are operable on the same computer hardware configuration. These future releases shall be made available to County at no additional cost only if such releases are made available to other licensees at no additional cost. Otherwise, the charge for such upgrading to the later version of the Software will be the difference between the price established by the Contractor for the later version and the price specified herein or the then prevailing prices of the currently installed version.
Future Releases. After the press release announcing the signing of this Agreement is issued, each Party may include the information included in such press release in subsequent press releases and other publications without the other Party's prior written consent, provided that such Party includes proper attribution of the other Party's name.
Future Releases. XOX shall use reasonable efforts to develop future releases of and improvements to the Software. XOX shall qualify and check for compatibility with a demonstration unit all future releases of the Software. XOX shall supply to the Company with each future release a set of regression tests which exercise the Software and indicate the proper operation of the Software. Delivery of a release of the Software shall be deemed to have occurred on the successful completion of an acceptance test. This test includes the ability to rebuild executables from the named libraries on Exhibit B and to successfully execute the supplied regression tests with results identical to those obtained by XOX. Pending mutually agreeable alternatives, the development environments to be supported are Solaris SparcCompilers, SGI C and C++ compilers and linker, and MicroSoft VC/C++ DeveloperStudio, respectively, for Sun solaris, SGI Irix, and PC NT platforms. Any XOX-developed compilation and linkage executables required to use off the shelf development environments to compile and link the elements in the source tree into the above libraries shall be provided by XOX for each platform promptly upon request by the Company.
Future Releases. Evaluator acknowledges that: (a) the Vytex NRL may not be in the form of subsequent releases and may contain different levels of proteins or have different characteristics within batches; and (b) Company reserves the right, in its sole and absolute discretion, to alter prices, features, specifications, capabilities, functions, licensing terms, release dates, general availability or other characteristics of the Vytex NRL.
Future Releases. If improved versions of any Software Product are developed by Contractor, and are made available to other licensees, they will be made available to the State at the State's option according to the specifics contained in the Statement of Work.

If Contractor offers new versions or Upgrades to the PIMS, they shall be made available to County at County’s option at a price no greater than the Contract price plus a price increase proportionate to the increase from the list price of the original version to that of the new version, if any. If the Software product has no list price, such price increase will be proportionate to the increase in average price from the original to the new version, if any, as estimated by Contractor in good faith.
