From Subscriber. Subscriber represents and warrants that: (a) it has the full right and authority to enter into, execute, and perform its obligations under this Agreement and that no pending or threatened claim or litigation known to it would have a material adverse impact on its ability to perform as required by this Agreement; (b) it has accurately identified itself and it has not provided any inaccurate information about itself to or through the System; and (c) it is a corporation, the sole proprietorship of an individual 18 years or older, or another entity authorized to do business pursuant to applicable law.
From Subscriber. Subscriber represents and warrants that: (a) it has the full right and authority to enter into, execute, and perform its obligations under this Agreement and that no pending or threatened claim or litigation known to it would have a material adverse impact on its ability to perform as required by this Agreement; (b) it has accurately identified itself and it has not provided any inaccurate information about itself to or through the System; (c) it is a corporation, the sole proprietorship of an individual 18 years or older, or another entity authorized to do business pursuant to applicable law; (d) that it has obtained or will obtain all consents and provided or will provide all notices required by Applicable Laws with regard to its use of the Services; (e) it owns or otherwise have and will have all necessary rights, permissions, and consents in and relating to the Subscriber Data (other than AI Subscriber Output) so that, as received by March Networks and processed in accordance with this Agreement, it does not and will not infringe, misappropriate, or otherwise violate any intellectual property rights, or any privacy or other rights of any third party or violate any applicable law, and (f) no Subscriber Data (other than AI Subscriber Output) contains or will contain any Excluded Data.
From Subscriber. When Subscriber signs up to receive, add or extend a Service, CAC and KVH collects data Subscriber voluntarily provides such as names, contact details (address, email and phone number), billing contact details and payment method, and other data detailed on the Activation Service Order to fulfill the terms of this Agreement. In providing certain Services, CAC and KVH collect location data from Subscriber’s vessel or connected device such as GPS, latitude and longitude information, and images of the various locations. At Subscriber’s election, CAC and KVH supplements this data with information you disclosed about your location (such as your postal code) to provide content that may be of interest to Subscriber. CAC and KVH also may collect Personal Data when Subscriber visits a customized website or Customer Account Portal (as defined in Section 51), including email address, telephone number, username or login.
