Frequency of Benchmarking Clause Samples

Frequency of Benchmarking. (a) With effect from the Effective Date, the Parties shall instruct the Independent Expert to perform a Benchmarking Survey on an annual basis in accordance with the timeline set out in Schedule J (‘Price Book Update Timescale’). (b) In addition to the provisions of this clause 11.4, the Parties may agree (which agreement may be withheld in a Party’s sole and absolute discretion) to instruct the Independent Expert to perform a Benchmarking Survey with respect to a specified period at any time during the Term.
